Let me write some knowledge about Contracts (employment) which is so important while working in foreign and that is also the one we didn't familiar with in our country. Contract is to bind two parties in order to get the best for each party's interest. In fact, we are on the losing side because we need job from them but we need to grab our best as much as we can. That is because my manager said "we have to do the contract to our advantage". Ok, let's start-
Let's presume u have finished the interview...
ကၽြန္ေတာ္ေရးတာ မျပည္႕စုံပါဘူး လုိအပ္ခ်က္ေတြေတာ့ ရွိဦးမွာပါ။ အေျခခံလုိအပ္ခ်က္ေတာ့ ၿခံငုံမိမယ္ထင္ပါတယ္။ ျငင္းၾကခုံၾကရင္းနဲ႔ ျပည္႕စုံသြားပါလိမ့္မယ္။
Let's presume u have finished the interview...
- do not show any hesitation to the negotiator / other party (HR manager or else)
- read the contract he or she gave precisely, make sure u understand the words overall
- you can add or delete the contents getting the consent with other party [ don't forget to write down the notes u negotiated ]
- general items that should include in contract are:
- Salary
- Officer Grade / Position and rank
- Leave (for the whole year)
- Medical Claim (which is can b claimed from company when the employee falls sick and goes to doctor)
- Rules and Regulations
- Form of Payment (Direct credit to bank will be better)
- Confirmation / Probation and its regulations (may be within probation, company can terminate you if they don't satisfy with employee performance by giving the default / mistake..in two days or whatsoever)
- Regulations after Confirmation / Probation
- Termination of the Contract (Most companies put the clause like this: After confirmation, both party may give the letter of termination 2 months in advance or terminate without waiting 2 months by paying the equivalent amount to the employee. (အဲဒါက ၂ လ ေစာင့္ရင္ေစာင့္၊ မေစာင့္ခ်င္ရင္ ၂ လစာ ေပးၿပီးထုတ္မယ္လုိ႔ေျပာတာပါ၊ ထြက္ခ်င္ရင္လည္း အဲလုိထြက္လုိ႔ရပါတယ္.. ႏွစ္ဖက္စလုံးအတြက္ပါ). The employer shall have the right to terminate the contract by giving the other party 2 months notice in writing, without requiring to provide any reasons or whatsoever) this is acceptable because this will make to their advantage.
- But Some cruel companies will put some clause like this: After confirmation, the employee may give the letter of termination 2 months in advance by paying the amount of the remaining months for the whole contract. (အဲဒီစာေၾကာင္းပါရင္ေတာ့ သတိထားပါ၊ ညွိႏႈိင္းသူနဲ႔သေဘာတူညီခ်က္ယူၿပီး ဒီစာေၾကာင္းကုိ တစ္ေၾကာင္းျခစ္တား (strike through) ၿပီး sign ထုိးလုိက္ပါ) မဟုတ္လုိ႔ ဖ်က္လုိ႔မရဘူး ဟုိဘက္ကသေဘာမတူရင္ေတာ့ စဥ္းစားေပါ့။ တစ္ခါတစ္ေလေတာ့လည္း အလုပ္ကအဆင္ေျပပါတယ္.. သူတုိ႔ကသာ လုိရမယ္ရ cover လုပ္ထားတာမ်ဳိးရွိပါတယ္။ စာခ်ဳပ္ကာလျပည္႕တဲ့အထိလုပ္၊ အဆင္မေျပရင္ေတာ့ အစမ္းခန္႔ကာလ အတြင္း ရေအာင္ထြက္ေပါ့။
- important thing is if you want to add (add the content clearly and Sign) and that will be the same for deleting the content (strike through clearly and Sign) [ I also didn't know that we can add and delete but now i got to know because i have to prepare the contracts for my company when needed ]
- When finish, talk to the other party that you have noted the amended items and negotiated things and will keep that note in order to have a record (ဒါက ဒီထပ္ထည္႕တဲ့ အခ်က္ေတြ အတြက္ မွတ္ထားတယ္ေပါ့၊ အဲဒါကုိ သေဘာတူညီခ်က္တစ္ခုအေနနဲ႔ သိမ္းထားလုိက္မယ္ေပါ့ ျဖစ္ႏုိင္မယ္ဆုိရင္ သူ႕ကုိျပၿပီး ႏွစ္ဦးလက္မွတ္ထုိးလုိက္ေပါ့။)
